1. Acceptance of Terms

By creating an account or using EverAfter Vault ("the app", "the service"), you agree to these Terms of Service. If you do not agree, do not use the app.

2. Description of Service

EverAfter Vault is a digital legacy vault that allows you to securely store sensitive personal information and configure conditional release to trusted contacts based on inactivity or other conditions you define.

3. Not a Legal Instrument

EverAfter Vault is not a legal will, testament, trust, power of attorney, healthcare directive, or any other legally binding instrument. The app does not constitute legal advice and is not a substitute for consultation with a qualified attorney. Information released through EverAfter Vault has no legal force regarding property transfer, estate distribution, or any other legal matter. You are solely responsible for creating legally binding estate planning documents through proper legal channels.

4. Account Responsibilities

You must be at least 18 years of age to create an account.
You are responsible for maintaining the security of your device and biometric authentication.
You are responsible for the accuracy of information stored in your vault.
You are responsible for keeping your trusted contact information up to date.
You must not use the service for any unlawful purpose.

5. Vault Content

You retain full ownership of all content stored in your vault.
We encrypt your vault content on your device before it is synced to our servers.
We do not access, read, analyze, or monetize your vault content under normal operation.
Vault content is only decrypted server-side during a verified release event that you have configured.

6. Release Mechanism

The release mechanism operates based on the policy you configure, including check-in intervals, grace periods, and confirmation requirements. You acknowledge that:

The release mechanism depends on technology that may experience failures, delays, or interruptions.
We make no guarantee about the timing or reliability of the release process.
False releases may occur due to missed check-ins, device issues, or other factors.
You can cancel an active release by opening the app and authenticating with Face ID.
Released content that has been accessed by recipients cannot be recalled.

7. Trusted Contacts

You are responsible for obtaining consent from individuals you designate as trusted contacts.
Trusted contacts will receive email communications from EverAfter Vault regarding their designation and, if applicable, released vault items.
Trusted contacts may accept or decline their designation at any time.

8. Availability & Limitations

We strive for high availability but do not guarantee uninterrupted service.
Scheduled maintenance, infrastructure failures, or force majeure events may affect service availability.
Push notifications and email delivery depend on third-party services (Apple Push Notification Service, Resend) that are outside our direct control.
The service requires an active internet connection for syncing and release operations. Offline vault access is available for previously synced content.

9. Account Deletion

You may delete your account at any time through the app's Settings.
Account deletion is permanent and irreversible.
All vault items, contacts, release policies, and associated data will be permanently removed from local storage and our servers.
Content that has already been released and accessed by recipients prior to deletion cannot be recalled.

10. Limitation of Liability

To the maximum extent permitted by law, EverAfter Vault and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of access to digital assets, failure of the release mechanism, premature or delayed release of vault content, or any damages arising from unauthorized access to your account.

Our total liability for any claim arising from or related to the service shall not exceed the amount you paid for the service in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless EverAfter Vault and its operators from any claims, damages, losses, or expenses arising from your use of the service, your vault content, or your violation of these terms.

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes through the app or via email. Continued use of the app after changes constitutes acceptance of the updated terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the service operator is registered, without regard to conflict of law provisions.
